Common Estate Planning Questions

This page offers answers to the most common estate questions.

What is an estate plan?
Estate planning is the planning for care of one’s family and the orderly transfer of one’s property at death.

Why would I want a Will?

  1. Disposition of assets should be your choice, not the legislature’s choice for  the hypothetical “average” person.
  2. To express intentions clearly to family and minimize confusion/doubt over disposition of assets
  3. Need to handle special situations
    1. Unique Assets
    2. Unique personal situations
  4. To control the choice of fiduciaries

Doesn’t Minnesota already have a Will for me?
Yes, they are called the Intestate Succession Statutes and can be found at
this page.

Who will take care of my minor children if I don’t have a Will?
The District Courts decide who will take care of your minor children.

What if I don’t want to be kept alive by artificial means?
Your Health Care provider will keep you alive by artificial means unless you execute a health care directive stating that you don’t want to be kept alive by artificial means.

What if I’m not terminally ill, but not compete to handle my affairs?
You need an executed Power of Attorney.  The document designates someone you appoint to handle your affairs (i.e. real estate, banking) should you become incompetent.

If you desire a Will or Trust, Power of Attorney, and Health Care Directive to address all these questions and to prevent the Minnesota Legislature or a District Court judge from deciding intimate questions about your affairs, then contact our office or submit our completed questionnaire via email to Horton Law Offices, LLC.

"I own my own business and recently I got into a contract with a vendor that became a horror story.  We had written and oral promises that were going no where.  I wanted the contract terminated and the vendor would not agree.  The whole situation was getting costly for me.  I brought in Mark Horton into the picture and quickly the confrontation came to a close. I found Mark level headed and an attorney that worked easily with the other parties.  Smart is not a strong enough word to describe this guy."  J.P.
