What is an estate plan?
Estate planning is the planning for care of one’s family and the orderly transfer of one’s property at death.
Why would I want a Will?
- Disposition of assets should be your choice, not the legislature’s choice for the hypothetical “average” person.

Doesn’t Minnesota already have a Will for me?
Yes, they are called the Intestate Succession Statutes and can be found at
this page.
Who will take care of my minor children if I don’t have a Will?
The District Courts decide who will take care of your minor children.
What if I don’t want to be kept alive by artificial means?
Your Health Care provider will keep you alive by artificial means unless you execute a health care directive stating that you don’t want to be kept alive by artificial means.
What if I’m not terminally ill, but not compete to handle my affairs?
You need an executed Power of Attorney. The document designates someone you appoint to handle your affairs (i.e. real estate, banking) should you become incompetent.
